INTERNAL RULES

PREAMBLE

 

Article 1 -Purpose and scope'application du règlement

These rules apply to all participants in a training course organized by the SCYFCO SAS training center.

The regulations define health and safety rules, general and permanent rules on discipline, as well as the nature and scale of sanctions that may be taken against trainees who breach them, and the procedural guarantees applicable when a sanction is envisaged.

All participants in training courses organized by SCYFCO must abide by the terms of these rules throughout the course.

 

SECTION 1: HEALTH AND SAFETY RULES

 

Article 2 - General principles

Preventing the risk of accidents and illness is imperative and requires everyone to respect :

- health and safety regulations applicable to training sites;

- any instructions imposed either by the training center, the trainer or the manufacturer, particularly with regard to the use of the equipment provided.

Each participant is responsible for his or her own personal safety and that of others, and for complying with general and specific health and safety regulations applicable to his or her training.

If he notices a malfunction in the safety system, he immediately notifies the training center management or the nearest trainer.

In addition, course participants are expected to respect the environment and, in particular, to ensure that waste is systematically collected.

Failure to comply with these instructions may result in disciplinary action.

 

Article 3 - Fire instructions

An evacuation plan is posted at the entrance to the building and, if necessary, on each landing. Fire safety instructions are also posted at the same access points. Participants must respect fire safety instructions and equipment.

Information on safety, evacuation procedures and the assembly point will be given to participants on arrival, under the responsibility of the course director.

Any misuse of safety equipment outside a fire hazard situation may result in disciplinary action.

 

Article 4 - Use of equipment

Training equipment may only be used on the training site and exclusively for training purposes. The use of equipment for personal purposes is prohibited.

The participant is responsible for keeping the equipment entrusted to him/her for training in good condition. They must use it in accordance with its purpose and the rules issued by the trainer.

The participant immediately informs the trainer of any equipment malfunction.

 

Article 5 - Alcoholic beverages and drugs

The introduction or consumption of drugs or alcoholic beverages on the premises is strictly forbidden. It is forbidden for participants to enter or remain on the training premises in a state of drunkenness or under the influence of drugs.

Trainers are authorized to carry out breathalyzer tests. In the event of a positive alcohol test, the participant will be dismissed immediately. This reasoned decision will be communicated to the funding bodies and to the employer.

 

Article 6 - No smoking or vaping

Smoking and vaping are strictly prohibited on the training premises. Outside, trainees must dispose of their cigarette butts in the ashtrays provided at the building entrances.

 

Article 7 - Accident

Any accident, however minor, occurring during attendance at the training center or on the way to and from the center, must be reported immediately to the center management. Violations of safety obligations may result in the application of one of the sanctions provided for in the present regulations.

 

Article 8 - Use of personal vehicle

As the training courses are based on the principle of continuous sequential training, participants will not be required to use their own vehicles; the means of transport used during the course will be provided by the training center. Any use of a personal vehicle, for whatever reason, during the training course, will give rise to the signature, by the participant, of a document informing him/her of the consequences of this use in the event of an accident.

 

Article 9 - Insurance and medical fitness

The training center has individual accident insurance, which does not require the production of a medical certificate of fitness.

However, the training center will recommend the production of a medical certificate of fitness for any activity that could be assimilated to acrobatic courses at height.

 

 

SECTION 2: GENERAL DISCIPLINE - OPERATION OF THE CENTER

 

Article 10 - Attendance of the participant

Article 10.1. - Training timetable

Participants must adhere to the timetable set and communicated in advance by the training center on the provisional schedule provided in the agreement. This schedule is subject to modification throughout the course, and any changes will be communicated by the trainers in due course.

 Failure to comply with the agreed timetable may result in sanctions.

Article 10.2. - Emargement

Attendance sheets must be signed by participants every day.

Under no circumstances should participants leave the course without signing their attendance sheet.

Article 10.3 - Absences, lateness or early departure

All participants are required to attend the course regularly. Any absence must be justified in writing by the participant or his/her company to the training center director or his/her representative on site (the trainer). These justifications will be forwarded to the funding bodies.

In the event of absence, lateness or early departure, participants must notify the training center and justify their absence.

Any event not justified by special circumstances constitutes misconduct liable to disciplinary action.

 

Article 11 - Access to training premises

Training rooms are made available to participants by the organization hosting the course. These rooms and the teaching aids in them must be returned in the same condition as when they were made available to the participants.

Unless expressly authorized by the management of the training center, the participant may not :

- enter or remain on training premises for purposes other than training;

- introduce, cause to be introduced or facilitate the introduction of persons not belonging to the organization ;

- sell goods or services in the latter.

 

Article 12 - Dress code

For outdoor activities, participants should bring hiking boots, a pair of sports shoes and warm clothing. Appropriate clothing will be provided.

 

Article 13 - Use of mobile communications

The use of mobile communication devices during training sessions is prohibited. However, rest periods will be scheduled during the day to allow participants to communicate.

It is possible to connect to the Internet using the training center's equipment. Prior identification of the user is required. In the event of consultation of illicit content, the user may be liable to prosecution.

 

Article 14 - Meals

Meals are taken at catering outlets selected by the training center. It is strictly forbidden for participants to take their meals outside the designated areas.

 

Article 15 - Transportation

The training center recommends the use of public transport to get to and from the training center. As outdoor activities are a significant source of fatigue, the training center strongly advises against the use of personal vehicles by participants at the end of their training.

However, access to training sites with a personal vehicle is permitted. Parking areas are not guarded, and vehicles remain the sole responsibility of their owners.

 

Article 16 - Formalities attached to the follow-up of the training

At the end of the training course, the participant receives a certificate of completion, to be sent to his/her employer/administration or to the organization financing the course, as appropriate. If the participant leaves the training course before the scheduled end date, he/she will be given, at his/her request, a certificate of completion attesting to the period during which he/she attended the course.

 

Article 17 - Conduct

All participants are asked to behave in a way that ensures respect for the basic rules of good manners and community spirit, and the smooth running of the training courses.

 

 

SECTION 3: DISCIPLINARY MEASURES

 

Article 18 - Disciplinary measures

Any failure by the trainee to comply with any of the provisions of the present internal regulations may result in a penalty being imposed by the director of the training center or his representative.

Depending on the nature and seriousness of the misconduct, the following sanctions may be applied:

- written warning from the director of the training center or his representative ;

- permanent exclusion from the course.

Fines or other financial penalties are prohibited.

The head of the training center or his or her representative will inform you of the penalty imposed:

- the participating employee's employer or the participating employee's administration (only when the training is commissioned by the employer or administration);

- and/or the course funder.

 

Article 19 - Disciplinary guarantees

Article 19.1. - Information to the participant

No penalty may be imposed on a participant unless he or she has first been informed of the grievances against him or her in accordance with the procedure described below.

Article 19.2 - Notice of interview

When the director of the training center or his representative is considering imposing a sanction, the procedure is as follows:

- it summons the participant - by hand-delivered letter against receipt - indicating the purpose of the summons;

- The invitation also indicates the date, time and place of the interview, as well as the possibility of being assisted by a participant or employee of the training center.

Article 19.3. - Possible assistance during the interview

During the interview, the participant may be assisted by a person of his or her choice.

The director or his representative will indicate the reason for the proposed sanction and will hear the participant's explanations.

Article 19.4. - Imposition of the sanction

Sanctions may not be imposed less than one clear day or more than two weeks after the interview.

Penalties are notified to the participant in writing, with reasons, by registered letter or by delivery against receipt.

 

Article 20 - Publicity of the rules of procedure

These rules are available in a binder from the course director at the training center, and on the training organization's website.

It is the responsibility of each trainee to read this document before starting the course.
